The following notice is being provided on behalf of Arena Capital Advisors, LLC (“Arena”):

Arena is committed to keeping nonpublic personal information about you secure and confidential. This notice is intended to help you understand how we fulfill this commitment. This privacy policy applies to prospective, existing and former clients.

We may collect a variety of personal nonpublic information about you, including:

  • Information we have received from you in meetings, via the telephone, through websites, correspondence, e-mail, subscription agreements and related documents, or other communications (including face-to-face meetings) with us or our representatives;

  • Information about your transactions with us and/or our affiliates, such as purchases, sales, or account balances;

As a matter of policy, we do not disclose your nonpublic personal information to anyone other than our affiliates, except as permitted by applicable law or regulation, such as to our accountants, attorneys, auditors, brokers, regulators and certain service providers, in such case, only as necessary to facilitate the acceptance and management of your investment or account and our relationship with you. For example, we may share the information described above with others in order to process your transactions or service your accounts. We may also release information about you if you direct us to do so or if obligated to do so by law, or in connection with any government or self-regulatory organization request or investigation. For example, it may be necessary, under anti-money laundering and similar laws, to disclose information about you in order to accept investments.

We may also provide the information described above to companies that perform administrative services on our behalf. We require these companies to protect the confidentiality of your information and to use it only to perform the services for which we hired them. We do not supply your nonpublic personal information to third parties for their marketing purposes.

We seek to carefully safeguard your private information and have implemented physical, electronic, and procedural safeguards to help protect your nonpublic personal information, and we restrict access to nonpublic, personal information about you to those employees and other persons who need to know that information to provide products or services to you. Additionally, Arena’s disposal of nonpublic personal information shall be done in a secure manner.

If at any time in the future it becomes necessary to disclose any of your nonpublic personal information in a way that is inconsistent with this policy, Arena shall provide you advance notice in order for you to have the opportunity to opt out of such disclosure.
